| 摘 要： | 执行竞合是民事执行中客观存在的一种现象 ,采取何种原则解决执行竞合问题 ,各国民事诉讼法有不同的规定。本文分析了执行竞合的构成要件 ,考察了执行竞合的三种形态 ,结合我国的执行立法和执行现状 ,提出了解决执行竞合的原则和方法。
