中国古代司法中有着很多的智慧,这些司法智慧不仅彰显出了中国古代司法的闪光点,弥补了当时司法技术的不足,促进了司法公平与正义,对当时的司法起到了很大的积极意义,而且对后世司法也有较大的借鉴意义与参考价值。本文从司法制度设计、司法价值理念、司法实践等三个方面对中国古代的司法智慧展开探讨与解析,以求了解古代司法智慧的面貌。

The Wisdom of Judicature in Ancient China

Judicature in ancient China boasts of wisdom which not only manifests the merits of judicature in ancient China, but also makes up the deficiency of judicial technology, promotes judicial equity and justice, exercises positive influence then and is still significant today. In order to thoroughly understand the wisdom of judicature in ancient China, the present study explores and analyzes this issue from the perspectives of system design, value idea and judicial practice.
