| 摘 要： | 现行的死刑复核制度存在复核范围不明、复核程序不透明、复核方式不规范、复核内容简单片面等诸多缺陷.两起典型冤案暴露出死刑复核制度形同虚设的弊病,应当从立法与程序设计上对其加以改进与完善.

| Abstract: | The present system of the reviewing death penalty exists lots of the s hortcomings such as the limits of the reviewing are not clear, the reviewing the procedure is not transparent, the reviewing style isn't normal and the reviewin g context is too simple. The two typical unjust case expose the malady which the system of the reviewing death penalty is nothing but an empty shell. So it shou ld be improved in the design of the legislation and procedure. |
