| 摘 要： | 是否承认引发物权变动的物权行为及其无因性一直是学界关注的焦点。然而,这种理论表达与社会实践之间却存在着巨大的差距。现实生活中最常见的问题是商品房买卖中出卖人拒不过户、未经登记的房屋一房二卖等问题。对此,物权行为理论并未提供有效的解决策略。

Under this circumstance, the common trouble is that the bargainor refuses to change the name of owner in a register, or sells one house to two or more persons. While, the theory juristical act does not provide any useful strategy. |
