| 摘 要： | 程序公正是实现实体公正的前提,用不当程序纠正错案,不但会影响到错案的纠正,而且会再一次损害司法机关的威信和法律的尊严,甚至会出现出新的错案。纠正错案,必须遵循刑事诉讼的基本制度,严格遵守法定程序。

| Abstract: | The proper process in correcting misjudged criminal cases is the prerequisite of gaining fair results,while the improper process will not only exert influences on the correction of misjudged criminal cases but also damage the prestige of judicial agents and laws' dignity.What's worse is that it may result in new misjudged criminal cases.In addition,when ratifying the misjudged cases,we should strictly obey the essential system of criminal lawsuits and law procedures. |
