| 摘 要： | 偶然防卫与正当防卫紧密相关。对于偶然防卫是否具有可罚性，争议较大。分析、考察偶然防卫具有可罚性的通说理论和否认偶然防卫具有可罚性的新说，可以得出偶然防卫不属于正当防卫的结论，因此，具有可罚性。

| Abstract: | Fortuitous defense is closely related to justifiable defense and the punishability of fortuitous defense is disputed bitterly. The conclusion that the fortuitous defense does not belong to justifiable defense can be drawn after having investigated the common theory that approves the punishability of fortuitous defense and the new theory that denies it. Therefore, the occasional defense has punishability. |
