论海上共同开发“区块”的选择问题

从目前海上共同开发的理论与实践来看,海上共同开发"区块"的选择主要涉及"区块"的地理范围、具体面积以及与领海的关系等。影响海上共同开发"区块"选择的因素主要有:政治意愿、经济考量、所涉国家的多寡、主张的合法性以及文化因素等。为了推进中国与有关国家在南海共同开发"区块"的选择工作,有必要进一步拓展在南海的地理和资源的调查活动,选择的潜在共同开发"区块"宜小,要鼓励石油公司积极参与南海的共同开发活动。

On Identification of the Zone of Joint Development in Sea

Form the perspective of theory and practice of the joint development in sea, identif- ying zone mainly include geographical factor, concrete area and relation with territorial sea. There are some elements affecting the identification of the zone, such as political will, economic factor, number of states concerned, legality of claims and cultural factor. In order to promote identification of the zone between China and states concerned, it is necessary to further develop investigation about geography and resources and identify a small zone with a limited number of parties in the South China Sea. Moreover, oil companies will be encouraged to join actively in joint development activities inthe South China Sea.
