刘少奇与苏联宪法的移植简

新中国的宪政建设在发端之初就走上了移植外来法的道路,从宪法制定到宪政实践,均受到苏联宪政模式的广泛影响.在苏联宪法理论于中国大陆全面传播之时,刘少奇作为苏、中法律嫁接的桥梁,将苏联的制宪建议、宪政精神和选举制度等传入中国;通过移植苏联宪法,主持和参与新中国第一部宪法的制定工作,为“五四宪法”的诞生作出了卓越贡献.

Liu Shaoqi and the Transplantation of the Soviet Constitution

New China has chosen to follow the route of transplanting the foreign laws since the beginning of constructing the constitutional government. Since then, the Soviet constitutional govern- ment mode gave great influences to new China, from the enactment of constitution to the practice of constitutionalism. When the theory of the Soviet constitution disseminated fully in China, as the law connecting point between China and the Soviet Union, Liu Shaoqi introduced the suggestion of enac-ting constitution, the spirit of constitutionalism, the electoral system and so on, to China. Through transplanting the Soviet constitution, he took part in and took charge of the enactment work of the first constitution of new China, making outstanding contribution to the naissance of the Five Four Constitution.
