意识：著作权刑法保护的重心

法律的生命在于适用,在于实效,如果无法在现实生活中得以贯彻实施,即便最完备的法律也等于废纸一张。我国刑法对著作权犯罪作了较为详备的规定,然而在现实中实施效果并不理想,造成这一状况的根本原因在于著作权刑法保护意识的薄弱。法律意识既是法需要向法创制过渡的中介,也是法规范向法关系转变的桥梁,法律意识具有构建和运行法制的功能。著作权刑法保护意识匮乏成为著作权刑事法律制度向著作权刑事法律关系运行中的滞阻因素。加强著作权刑法保护意识,对提高著作权刑事法律制度的实效,抑制著作权犯罪的泛滥有着重要意义。

The carryout of crime of authorship law is not so successful though there are complete regulations on the crime of authorship of criminallaw in China because of the weak consciousness of protection. Law consciousness is the bridge of the transaction from the need of law to the is-suing of law and from the norm of law to the relation of law. Law consciousness can build and run law. The lack of consciousness of authorshiplaw is a block of the run of authorship criminal law. It is significant to prevent crime of authorship by strengthening the authorship criminal lawconsciousness and improving the efficiency of authorship criminal law system.
