| 摘 要： | 因非法经营罪的刑法条款规定不甚明确具体,在认定该罪时存在不同的理解和适用。本文通过分析涉烟非法经营罪认定中的三个关键问题,即"违反国家规定"的含义、非法经营行为的类型和"情节严重"的界定,对如何在司法实践中适用非法经营罪提出自己的观点,并在分析现有司法解释的基础上,提出应完善上海实践中的涉烟案件适用法律指南。
