| 摘 要： | 合同成立与生效是合同法上的两项不同的制度,合同成立是生效的前提和基础,依法成立的合同对当事人具有法律约束力。《合同法》关于成立与生效的规定,将会给我国合同纠纷的审判实践带来一场新的变革,审判机关对合同纠纷案件的处理,可不再一概都确认合同是否有效,也可确认合同是否依法成立。

The provisionsconcerning the establishment and the validation of a contract in the Contract Law will innovate the trial practice in thesettlement of contractual dispute. |
