| 摘 要： | 近年来不断涌现的大学生诉高校不当处分案 ,反映了学校惩戒权与学生受教育权的现实冲突正在加深 ,实体规则的缺陷、程序规则的缺乏以及救济渠道的不畅都是导致惩戒权与受教育权失衡的原因 ,如何对处于强势地位的学校惩戒权进行规制 ,实现两者的利益平衡 ,在理论和实务上都有很大的意义。

| Abstract: | The defect of substantive regulation, the lack of procedure and the blocking of saving path result in the consistent cases of college students going to court for universities' undeserved punishment. This reflects the deeper conflict between universities' authority of giving punishment and students' right of receiving education. How to balance two sides' benefits is a problem with great meaningfulness. |
