“法治”视野下“严打”政策的再度审视——兼采经济学的方法

对严打政策的再度审视应是多方面的,而效应与教训则是其极其重要的内容。严打政策既有正面效应,也有负面效应。严打政策的正面效应是短暂的社会稳定,并可得到经济学的说明;严打政策的负面效应是长远的,它不仅在观念上一度侵蚀着我们的法治信仰,动摇我们的公平正义感,而且在客观上酿成了新的对抗和秩序紊乱。严打政策的负面效应同样能够得到经济学的说明。从严打政策的负面效应中,我们所能得到的是严打政策的教训,并且其教训可得到经济学和犯罪学的共同说明。严打政策的教训将使得我们在应对犯罪、谋求稳定和实现法治化的道路上方向更加明确,步伐更加坚定,并将使得宽严相济政策在社会转型和风险多元的特殊历史时期得到更加稳妥有效的推行,从而助益于法治国的发展。

Reexamination of Policies Used in Campaign to Crack Down on Criminal Activities from the Perspective of Rule of Law --by Use of the Method of Economics

The policies used in campaign to crack down on criminal activities should be reexamined in many aspects, among which effects and lessons are very important. Those policies used have positive and negative effects. The positive effect is temporary social stability and can be illustrated by economics. The negative effect is long - term, which has once not only eroded our belief of rule of law and shaken our sense of fairness and justice, but also has objectively created new confrontation and disorder. The negative effect of those policies can also be illustrated by economics. From negative effects of those policies, what we can draw are lessons of those policies, which can be explained both by economics and criminology. The lessons drawn from policies used in campaign to crack down on criminal activities will ensure our direction more explicit and our pace more determined in the course of cracking down on crimes, seeking stability and realizing the path of ＂rule of law＂. As a result, the policy of combining？ punishment？ with？ leniency will be implemented in a more effective and safe way in the？ special？ historical？ period？ of social transformation and multiple risk, which will help to rule the country by the law.
