| 摘 要： | 国外大企业在我国层层部署专利,实行专利封锁,严重限制了我国中小企业的发展。中小企业一方面要尊重知识产权,另一方面又要限制专利权人滥用专利权。本文从企业研发、技术使用及侵权抗辩等几方面阐述了中小企业的具体应对对策。

| Abstract: | Foreign big companies always set patent barriers in our nation to limit the development of our medium size and small enterprises.This paper advocated that enterprises should not only respect the intellectual property right but also limit the abuse of the patent,meanwhile it discussed some measures to take from the aspect of companies' innovation,use of techniques and tort counterplea. |
