最密切联系原则在二十世纪六、七十年代美国的冲突法革命中逐渐成为一种引人注目的学说。在WTO所推动的全球化的今天,最密切联系原则更是各国国内立法和实践的一个重要内容。本文试图从法哲学角度对该原则进行剖析,指出其对传统概念主义国际私法观的改良及影响,并对多年来的法律实践所展现的该原则的隐患进行分析,以使我国相关司法工作能够完善。

Analyze the Doctrine of the Most Significant Relationship in the International Private Law

The Doctrine of Most Significant Relationship was a noticeable theory during the revolutionary of the Conflict Law in America in the sixties and seventies in twenty century. Today, at the time of globalization, the Doctrine of the Most Significant Relationship has become a more and more important content of the legislation and practice of the national law. From the perspective of philosophy of law, the author analyzes the theory and points out its influence and reform on the traditional conceptions of international private law and its hidden troubles existing in the law practices so as to perfect the theory.
