| 摘 要： | 新型毒品指主要依靠化学合成的毒品。新型毒品犯罪即指以新型毒品为犯罪对象的毒品犯罪行为。我国新型毒品犯罪具有生产消费本土化、涉案人员高知化和消费群体白领化的特征。我国刑事立法及司法应当：在对制毒技术和制毒原料的刑法管制上,严格限制相关犯罪认定的标准,防止过度入罪;严格监管含有精神药物的处方药,在刑法上设立＂非法出具处方罪＂和＂非法提供处方药罪＂;创新与探索戒毒领域的制度,而不是匆忙地将吸毒行为犯罪化,以更好地规制新型毒品犯罪。

| Abstract: | The new drugs are drugs synthesized in chemic way.The crime of new drugs is the crime relevant with new drugs.In China the crime has the following features： local consumption and manufacture,high intellectual suspects and many white-collar consumers.In criminal legislation and practice,we should regulate the crime further： firstly,restrict the conviction standard of the crime in control of manufacture technique and materials;secondly,enhance the supervision on prescription medicine with psychotropic drugs,and define the Illegally Providing Prescription Crime and Illegally Providing Prescription Drugs Crime in criminal law;thirdly,further the study on drug users rehabilitation,and do not bring the drug-abusing into crime roughly. |
