“和谐追逃”实证考量

＂和谐追逃＂是指公安机关通过做逃犯亲友的工作,促使逃犯主动投案,其尊重和彰显了刑法的人权理念,凸显了和谐社会视域下当代公安侦查工作的新观念。实证考量表明：过失犯罪的逃犯比故意犯罪的逃犯、激情犯罪的逃犯比预谋犯罪的逃犯、初犯逃犯比屡犯逃犯较容易实施＂和谐追逃＂。和谐追逃的思路是从思维观念上依靠群众来营造氛围,操作路径上依托媒体和基层组织,运用策略上排忧解难,真情感人。和谐追逃过程中涉及到对自首的认定和对过失犯罪的法定刑配置等相关法律问题。对自首的认定应补充一个可操作性的司法解释,以防止执法的随意性;对过失犯罪应配置财产刑和资格刑,减少自由刑,将有助于和谐追逃的实施。

＂Harmoniously Tracing Escaped Suspects＂ means that the public security organs let the relatives or friends of the escaped convicts advise the latter to deliver themselves to the police.It respects and embodies the concept of human right in the criminal law,and presents the new concept of contemporary police work in the harmonious social viewpoint.The positivist consideration shows that we can carry out the harmonious tracing for those chance-criminals,passion-criminals and first offenders easily than those criminals on purpose,with premeditation and high frequency.The working way of the method is that,to rely on people to construct the atmosphere,depend on the medium and basic units,solve the troubles using strategies,and affect the others with genuine feelings.It relates to the confirmation of giving-up and legal penalty to chance-crime： for the former,set up a judicial explanation;for the latter,reduce the free penalties.These benefit to carry out the harmonious tracing.
