| 摘 要： | 船舶优先权制度是海商法中一项特有的法律制度 ,船舶优先权的转移应根据不同的情况具体问题具体分析 ,那种认为只要第三人清偿了属于船舶优先权担保的债权 ,第三人即享有船舶优先权的观点是错误的 ;船舶被国家机关没收后 ,船舶优先权归于消灭 ,买受人取得的是干净船舶
