| 摘 要： | 《中华人民共和国国家赔偿法》修正案首次以"精神损害抚慰金"的形式对国家精神损害赔偿作了明确规定,但是缺乏相关的具体配套实施细则,这将导致国家精神损害赔偿实施陷入无序的境地。以"精神损害抚慰金"为切入点,从"精神损害抚慰金"的计算标准、适用标准、追偿制度等方面,就完善国家赔偿中的精神损害赔偿制度进行探讨。

| Abstract: | The amendment to the Law of the People＇s Republic of China on State Compensation first stipulated ＂mental damage solatium＂ for state compensation for mental damages. However, lack of the supporting detailed rules for the implementation will throw the implementation of state compensation for mental damages into disorder. Beginning with the introduction of mental damage solatium, this paper discusses how to perfect the system of compensation for mental damage from the aspects of the standard for calculating ＂mental damage solatium＂, standard for application, and recoverv system. |
