| 摘 要： | 高等学校享有对于学生的学习和品行进行评价的权力,但是这种权力不应滥用。学生对于学校的评价行为不服,可以寻求司法救济。本文提出在借鉴法国经验的基础上完善我国法院对于评价之诉的裁判机制。

| Abstract: | The university enjoys the right to conduct evaluation on the study and morality of the students, however, such right should not be abused. In case that the student does not agree with the evaluation conducted by the university, he may apply for judicial review. This article brings forward to make perfect the judgment mechanism of the evaluation litigation in courts of our country, based on referring to the French experiences. |
