| 摘 要： | 美国军用侦察机是国家航空器.依据国际法规范,国家航空器在专属经济区上空不享有随意飞行的权利;国家航空器未经许可不得进入他国领空;违法飞行的国家航空器,不应享有主权豁免.美国应对其在"南海撞机事件"中的违反国际法的行为承担国家责任.

| Abstract: | American military scout is state craft.According to norm national law,the state craft isn' t entitled to the right of flying above the exclusive economic zone freely;without permission,it couldn' t enter other country ' s territorial space;the state craft which flies delictually shouldn' d entitled to the right of potestas immunity.Therefore,America should be held state responsible for the behaviour which voilated the international law in"the accident of Airplane Crash in Southsea". |
