完善我国宪法监督制度之构想

设立宪法法院负责宪法监督工作是一种最切合实际的完善我国宪法监督制度的方案。除在中央设立宪法法院外,可在地方设立巡回宪法法院。宪法法院应当具有相对独立性。为保证宪法法院有效行使其宪法监督职能,必须赋予其事前审查权、宪法解释权等职权。宪法监督程序须由相应的主体提起。

A Study on the Perfection of China''''s Institution of Constitutional Supervision

The authors suggest that one of the most practicable way to perfect our institution of constitutional supervision should be to establish constitutional court to perform the power of supervising the performance of the constitution of China.We should establish both central constitutional court and circuit constitutional court.In order to perform their powers and obligations efficiently,the constitutional courts should be given the powers of prior review,of interpretation of the constitution.The court constitution should have comparatively independence.And only specific subjects have the power to start the procedure of constitutional supervision.
