网络反腐制度化构建新思路

网络反腐制度化不仅是保障公民参政权利的重要方式,也是克服网络反腐消极影响的必要条件,更是让"媒治"走向"法治"的必然选择。我国现有的网络反腐法律规定存在形式上零散且缺乏统一的立法理念和原则、内容上多为禁止性法律规范而少有授权性法律规范的缺陷和不足。对此,应当通过专门立法从三个方面加以完善:规范网民行为,使其正确对待和使用网络监督;加强网络建设,搭建专门、高效的网络反腐平台;构建配套制度,完备网络反腐监督体系。

Construction of New Ideas by Institutionalized Network Anti-corruption

Institutionalized network anti-corruption is not only an important way for citizens to participate in government, but a necessary prerequisite of eliminating negative influence of network anti-corrnption, as well as an inevitable choice of shifting from ＂media governance＂ to ＂rule of law＂. Some deficiencies and defects such as lack of unified legislative norms and principles, most of the contents concerning prohibitive legal norms rather than authorized legal norms still exist in the current network anti-corruption. In this regard, specific legislation should be perfected in three aspects, namely to regulate the behavior of internet users and make use of network regulation in a proper way; to strengthen network construction and build up a specialized and efficient network anti-corruption platform, and to construct coordinating regulation and perfect regulatory system of network anti corruption.
