技术类民事案件适用先行判决的正当性思辨与规则构建

先行判决,又称"部分判决",是与全部终局判决相对应的概念,指人民法院对已经审理清楚的部分事实和部分请求作出的判决。在技术类民事案件中适用先行判决,符合技术类案件的内在审判规律,可以及时保护权利人的利益,有效提升知识产权审判效率,是程序上的一次审理机制创新。文章对我国司法实务中适用先行判决的知识产权民事案件进行统计,针对司法实践中呈现的问题,提出需要明确先行判决的适用条件,构建二元启动模式,避免剩余标的处理方式的异化,在具体操作层面作出精细化设计,并借鉴英美法系的禁令制度,在同案中处理好先行判决与行为保全的关系。

On the Justification and Rules Construction in Applying Partial Judgement on Technical Civil Cases

Partial judgement is made on the part of a trial where facts and requests are evident. Compared with final judgement, partial judgement simplifies the procedure of the case, expedites the proceedings and enables relief granted in an early stage. Partial judgement is especially important in hearing technical civil cases, where technological facts are hard to be determined, damages are difficult to be calculated and the trial period is prolonged. Whereas in current judicial practice, judges are full of confusion in applying partial judgement, prone to deviate in understanding, and there exist various kinds of non-unified, non-standard application paradigm. Therefore, it is necessary to conduct a comprehensive and systematic study of partial judgement in technical civil lawsuits, to clarify its applicable scope and condition, handle the undecided part of the trial properly, and reconcile the rules of partial judgment with those of injunction, for the sake of further improvement in China’s intellectual property litigation system.
