“法律方法”的用语及概念解析

国内外学界对"法律方法"之用语的使用并不一致。应当用"法律方法论"一语来指称自1990年代以来国内学界关于法律解释、法律推理和法律论证等法律应用方面的研究。法律方法的研究是以法律适用为中心,从微观的视角来谋求法律自身的学问。作为一种职业性思维与技术,法律方法旨在处理事实与规范之间对立与紧张的难题,从而追求个案中法律判断的合法性与正当性;逻辑与经验构成法律方法的基本向度;法律知识、法律技能、职业伦理是法律方法的构成要素。

On Usage and Concept of Legal Method

The word "legal method" has been used in different sense by internal and external law circle.The word "legal methodology" should be used to refer to domestic studies of interpretation of law,legal reasoning,and legal argumentation,etc.which are related to practical study of law since the 1990's by domestic law circle.The study of legal method contributes to knowledge of law itself,from the concrete perspective of application of law.As a professional technique,legal method aims to deal with the problem of contradiction between facts and norms,and to reach for legality and rightness of judgment in concrete cases.Logic and experience has been considered as the basic dimension of legal method,and it consists of knowledge of law,technique of law,and professional ethics.
