| 摘 要： | 本文从考察陪审制度的历史沿革出发,分析研究古代、中世纪至近代资产阶级革命这一历史长河中,陪审现象向陪审制度嬗变的进程。根据当今世界各国施行陪审制度的不同情况,陪审制度分为三种不同的模式,即陪审团制、参审制以及我国的人民陪审制,三种模式的成因不同。

| Abstract: | Based on a review of the jury system in the history, this article studies the gradual transformation of jury phenomena into jury systems from the ancient times, the Middle Ages to the bourgeois revolution. The author explores respectively the conditions of the contemporary jury system in different countries and puts the system into three molds, i.e., the system of jury, the assessor system, and the assessor system of people. The contributing factors of the three molds are also analyzed. |
