迈向叙事的权利观——以一部电影为例对权利之客观性的反思

普通诉求的权利化是为当下的社会大众乃至学界所共同追求的一项目标。引起这种现象的根本原因在于法律文本主义和实证主义司法观在理论上和实践上对于权利客观性的迷思。在司法实践中 ,对权利客观化的过分追求可能导致人的异化以及权利的异化。以叙事的进路来推进权利的实现富有积极意义 ,这可以部分地消解对权利客观性的迷思 ,进而克服因此导致的异化现象。

Towards the Narrative Outlook of Right:A Reflectio non the Objectivity of Right with a Filmas an Example

To recognize ordinary claims as rights is a goal that t he public and academia pursuits today. It results from the blind faith that the judicial outlook of legal textism and positivism holds, both theoretically and p ractically, on the objectivity of right. In the judicial practice, the over purs uit for the objectivity of right may result in the dissimilation of human and ri ght. To promote the realization of right in a narrative approach will be meaning ful, which can partly overcome the blind faith on the objectivity of right, and thereupon can avoid the incidental dissimilation.
