| 摘 要： | 我国理论界和实务界对被害人上诉权问题存在支持论和反对论两种主要观点，应当在和谐社会的平衡司法理念下理性对待被害人上诉权问题，不能简单地持肯定或否定态度。理性的态度应该是在吸收双方观点中合理成分的基础上对我国被害人抗诉请求权进行合理改造，使被害人、被告人和国家（社会）三方面的利益达到一个相对平衡的状态。

| Abstract: | There are controversial viewpoints on the victims＇ right of appeal in the theory and practice. We can＇t simply hold a positive or negative attitude toward it. We should hold a rational attitude to the victims＇ right of appeal under the balance idea of justice in harmonious society. The right solution is to reform the vic- tims＇ right of request on the basis of absorbing the reasonable viewpoints of the two sides. It will balance the benefit of the state, the society and individuals. |
