小产权房的成因及法律解决途径

摘    要:小产权房的产生从根本上说是政府、农民及房屋开发商利益之争。由于近年来商品房价格的日益飞涨、土地资源日趋稀缺等多方面原因,导致小产权房的违规开发呈蔓延之势。规制小产权房的法律途径主要是:一要健全住房社会保障供应体系;二要完善有关小产权房的法律法规;三要疏堵结合,妥善处理现有的小产权房,制止未建及将建的小产权房。

Abstract:The distributing interests between government,farmer and real estate developer leads to the small property room came out.Recent years,the price of commercial room increases speedily,land resources are short in supply.These causes lead to the phenomenon that illegal development of small property room commonly.The legal ways to regulate this behavior are as following:first,improving the social room supplying system;second,improving the legislation;third,prohibiting the construction of new room.
