| 摘 要： | 公安部《道路交通安全违法行为处理程序规定》规定：交通警察一人可以当场作出处罚决定,在当事人拒绝签字、拒绝签收的情况下,应当在处罚决定书上注明。这种＂注明＂是否等于告知、能否代替送达是一个未明确的问题,它在实践中会影响到执法和当事人的权利,以及公平正义的实现。

| Abstract: | The traffic safeguard illegal behavior handle procedure regulation points out that:traffic police can make punishment decision by himself at present.If the man who refuse to sign,the police should write this situation in the decision document.Whether this kind of sign is same to announcement and delivery or not are a question.It will impact people's rights and fairness in practice. |
