| 摘 要： | 检察机关在民事执行案件中调查取证是必要的,但不能没有限制。检察机关的调查取证活动应当仅针对法院的执行活动进行,围绕诸如法院执行裁判错误、措施错误,执行人员违法违规的行为。赋予检察机关的任何一种调查取证权都是其在办理民事执行案件过程中为履行检察监督所必须的。
