论抢劫罪死刑的立法控制

抢劫罪作为一种常见多发的传统犯罪,在我国死刑适用中占有较大的比例。如何控制抢劫罪的死刑,直接关涉死刑控制的力度与效果,因而是当前刑法理论必须直面并着力研究的问题。以比较研究为逻辑起点,结合我国的具体立法,力图着重从立法角度探索抢劫罪死刑的控制问题。

As the frequent and easy-happened traditional crime in China,robbery accounts for a large percentage in the application of death penalty.So how to control the death penalty of robbery directly affect the intensity and effect of the death penalty controls.Therefore that topic becomes an urgent problem for current studying on criminal law theories.This article starts from comparative study which is regarded as the beginning point in logic,considering practical legislation of our country,and finally tries to explore the matter how to control the death penalty of robbery from the legislation angles.
