| 摘 要： | 长久以来,部分学者或者认为立法是发现法律的过程,或者认为是技术创设的过程,然而这两种看法都略失偏颇.立法是规范的法律规则(社会内生的)到建设的或技术的法律规则(实在法)的二度转化过程,是规则认识过程和法律创新过程的统一.通过对西方三大法学流派对立法原则影响的分析,可以看到"发现"与"创设"是不可分的立法过程中的两个环节.

| Abstract: | The legislation is a process of discovery or a process of creation that has long been a controversy. This article, through the analysis of the influence of the three genres of western law to the legislation principles, discusses the process of "discovery" and "creation" are the two inseparable aspects of legislation. |
