| 摘 要： | 针对“入世”的形势和国内一些学者的模糊认识 ,本文通过大量的实证分析指出 ,制订《反垄断法》无论从国际层面还是从国内层面均属必需 ,而且 ,立法需考虑这两方面的问题。在此基础上 ,笔者对《反垄断法》的核心问题即垄断的认定问题作了较详细的分析。

| Abstract: | China's entry into the WTO requires more reformations in many aspects,however,it seems that the domestic research is still lacking in embedded analysis.In the issue of anti-monopoly,although there are no special documents in the WTO,but its basic principles and spirit definitely demand specific anti-monopoly law in every member.In addition,it is necessary for any member to have its own anti-monopoly law to obtain the dominant right in international anti-monopoly legislation.Therefore,we should establish the anti-monopoly law as soon as possible and also make it elaborate according to the WTO regulations. |
