| 摘 要： | 沉默权对于保护被追诉人权利,抑制侦查权的滥用,遏制刑讯逼供和司法专横有着重要作用。它是一个国家刑事讼诉中人权保障状况和诉讼民主文明的标志。文章从沉默权历史发展的角度,阐明了我国目前尚未规定沉默权制度,同时有必要在吸收外国经验的基础上结合我国国情,确立具有中国特色的沉默权制度,进而推进我国的法制建设。

| Abstract: | The right of keeping silence takes an active action on restricting the abuse of torture and crime investigating ,clemin the judicial imperiousness.It is an civilized symbol in the proceeding and human right protection.This essay from the view of history,describes that our country have no legislation in the right of keeping silence and points out the importance of establishing the right according to our country's situation so as to strengthen our country's legal system. |
