我国改革中依法行政主体的基本类型

依法行政主体无论是在观念意义还是在法律规定上,在我国行政法制度建设中都是一个需要进一步厘清和清晰的概念。依法行政主体不是指行政法律关系中整体的权利义务主体,而仅仅指公共行政事务的承担者,从行政法治角度而言,凡承担公共行政事务的主体,都必须依法行政,都是依法行政主体。法律学上的主体无非有组织和个人两类,依法行政的主体也限于组织和个人两种。但是,那些组织和个人能够承担公共行政事务,不同的国家有不同的情况,就是相同的国家在不同的历史时期情况也是不同的。就中国而言,改革开放30年来,行政管理体制改革的任务远没完成,其中对公共行政概念、范围的理解,公共行政组织社会形态的定型,传统上全能政府向有限政府转变,管制行政向治理行政转变等等的改革成功,都是确立依法行政主体理论定型化的先决条件。

Basic Types of China's Reform of the Main Body of Administration according to Law

Administration according to law,whether in the concept of the meaning of the main provisions of the law,or in the construction of China’s administrative law system is a need to further clarify and clear concept.Administration according to law does not mean the principal administrative legal relations,rights and obligations of the whole subject,but simply refers to the bearer of public administration services,rule of law from the administrative point of view,whoever bears the main body of public administration services,must be according to law,are the main administration according to law.Jurisprudence on the subject is nothing but organized and individual categories,the main body of administration according to law is also limited to two kinds of organizations and individuals.However,those organizations and individuals can undertake public administration matters,different countries have different situations,that is the same country in different historical periods the situation is different.The case of China reform and opening up 30 years ago,China’s economic,political,social and embarked on a path of reform,administrative reform has not completed the task well,in which the concept of public administration,the scope of understanding,organizing social forms of public administration stereotypes,the traditional limited government on the all-powerful government to shift control of the executive administrative changes to the management of successful reform,etc.,are established by law theory of stereotyping in the main prerequisite.
