法学案例教学法研究

摘    要:法学案例教学法是基于普通法系案例教学的理念,采用典型法律案例教材,将学生带入案例中充当法律职业角色,由教师引导学生开展自主探讨性学习的一种教学方法。它具有目标性、启发性、实践性、自主性、综合性的特点。法学案例教学法应遵循联系实际、知识和能力并举、启发诱导三项基本原则。案例教学首先由教师选定典型法律案例并设计讨论的问题;其次学生扮演案例中法律职业角色并对所有问题展开分析与辩论;再次由教师总结案例讨论并进行点评;最后学生写出案例分析报告。这四个环节教学相辅相成,形成法学案例教学法的一般规律。

Abstract:The case-teaching method of law adopts typical case teaching material of law according to the i- dea of common system of the case-teaching method of law.It takes the students into the case,at the same time,lets them play the law occupation roles.It is a teaching method that guides the student study independent- ly.It has the characteristics of target,instruction,practicality,independently and synthesize.The case-teach- ing method has appeared since the ancient China and ancient Greece period.However,the source of case- teaching method of modem times is the system of British and American education of Laws.It was introduced into China in the early time of the 1980's.
