论量刑均衡及其实现路径

刑罚目的的实现，在很大程度上依赖于司法层面刑罚的正确适用，即量刑均衡的实现。量刑均衡是建立在罪刑相适应原则和刑罚个别化原则的理论基础之上的。它要求审判机关在适用相同刑事法律的背景下，对性质相同、情节相类似的犯罪案件，作相当的刑罚裁量，对同等犯罪科处同等刑罚，对类似的事件作出相同的裁判，以保持刑罚稳定和罪刑相适应。但刑事司法裁判中量刑失衡问题颇为突出，危害到了刑罚正义的实现和社会公众对法律应有的信仰和敬畏，妨碍了刑罚目的的实现。因此，必须从立法、司法层面采取切实可行的措施对量刑失衡问题予以解决，从而最终实现量刑的均衡。

On Balanced Sentencing and Paths of its Implementation

The achievement of the purpose of punishment largely relies on the appropriate application of punishment or the implementation of balanced sentencing. Balanced sentencing is established on the theoretical basis of both the principle of suiting punishment to crimes and the principle of individualization of punishment. According to balanced sentencing, judicial organizations should give equivalent adjudication of punishment to criminal cases of the same nature and with similar circumstances. Same punishment can be given to the same crime cases and same adjudication can be given to similar criminal cases so as to maintain stable punishment and suit punishment to crimes. However, in the adjudication of criminal justice, unbalanced sentencing does exist which jeopardizes the justice of punishment, the trust of the public in the law and the achievement of the goal of punishment. Therefore, effective measures of legislation and judicature should be taken to solve this problem and implement balanced sentencing.
