警察出庭作证之解析

英美法系的警察出庭作证制度,因其对诉讼公正和被告人诉讼权力的有效保障,而被越来越多的国家认可与采纳。目前,我国司法实践中存在许多有违司法公正的现象,要解决这些问题,我们必须借鉴这一制度。当然,由于我国的现实状况,借鉴确立这一制度有诸多困难,这要求我们必须有针对性地进行体制与文化的改革以及相关制度的完善。

A Brief Analysis of the Police Serving as a Witness at Court

In Anglo-American genealogy of law, the system of the police serving as a witness at court is being approbated and accepted by more and more countries for it can effectively safeguard the judicial fairness and the litigation right of the defendant. Currently, there are many problems which violate the judicial fairness. To solve these problems, we should use this system for reference. Of course, there are many barriers to the setup of such a system in China, so we must reform and improve relevant systems.
