司法实践中涉老精神赡养案件在“情、礼、法”上的统一与实现

自2013年7月1日起施行新修改后的《老年人权益保障法》以来,对涉老精神赡养案件在司法实践中的处理引起了不少法院的探索。文章立足对涉老精神赡养法律条文之立法意义的探讨,以重庆市某基层法院对涉老精神赡养的个案审理为研究对象,结合对我国传统文化的分析,进而提出改进涉老精神赡养案件审理机制的建议,以期确保该类案件的审理在＂情、礼、法＂上得到统一与实现。

Unity and achievement of "feeling,ethics and law" in spiritual support cases involving the old in judicial practice

Since the implementation of the new revised ＂Protection Act to the old＂ on July 1, 2013, the handling of spiritual support cases involving the old in judicial practice caused a lot of exploration to the courts. The article based on the discussion on the legislative significance of the laws of the spiritual support involving the old,studied the hearing of a spiritual support case involving the old in a grassroots court in Chongqing, combined with the analysis of China＇s traditional culture, then put forward suggestions to improve the hearing mechanism of spiritual support cases involving the old to ensure that the trial of such cases unified and achieved on ＂feeling, ethics and law＂.
