| 摘 要： | 目前学术界普遍存有对《周易》讼卦之讼的误读,这种误读甚至影响到了司法实践。事实上以历史语境言,讼从来源看具有必然的天理,从含义看具有丰富的法蕴而非仅指诉讼,从属性看则具有吉性而非为终凶,从深度看也绝无无讼之义。虽然历史上学术受政治影响是个不争的事实,但在构建和谐社会的今天,对讼卦之讼进行学术辩正仍有必要。
