| 摘 要： | 《行政复议法》第9条是关于申请期限的规定。对于如何适用该条规定,在复议和审判实践中存在一些不同的认识。从保障公民救济权利的立法目的出发,应在现有法律条文的基础上,尽量作出有利于申请人的解释,尽可能使案件进入实体审理。

| Abstract: | The Article 9 of the Administrative Reconsideration Law concerns about the application deadline. There are some different uderstandings about this article in reconsideration and trial practice.Considering the goal of legislation to safeguard citizen's right to get remedy, we should, on the basis of the existing articles, try to make interpretations in favor of theapplicants,and let the cases enter substantial trials as soon as possible. |
