| 摘 要： | 对惩罚性赔偿责任的争议由来已久。在立法上对这种赔偿制度加以类型化地规定 ,可进一步完善惩罚性赔偿制度以指导司法实践。在附带民事诉讼和妨害民事诉讼行为中应适用惩罚性赔偿责任。
