试论民事执行程序的检察监督

民事诉讼法修正案于2008年4月1日正式生效实施,此次修改中变动最大的要数审判监督程序和强制执行程序两大部分。但从修改的内容和民事执行中现存的问题来看,强制执行的修改依然无法解决现存的一些问题。针对现存的"执行乱、执行难"问题,民诉法仍没有提供很好的对策。确立民事执行程序的检察监督可以在很大程度上解决这些问题,主要对民事执行检察监督的制度建构进行论证,旨在抛砖引玉,求教于方家。

On the Procuratorial Supervision of Civil Implementation Procedures

The Civil Procedure Law of the People's Republic of China(amanded in 2007) came into effect on 1st April.There are two parts changed most in this revision,one is the trail supervision procedures and the other is enforcement procedure.But seen from the content of the revision and the existing problems in the civil implementation,the amendment of the enforcement still can not solve the gordian knot.Therefore,the author thinks that,to construct the procuratorial supervision of civil implementation procedures can largely put the axe in the helve,and the main content of this paper is to demonstrate the system construction of the procuratorial supervision of civil implementation procedures for throw a sprat to catch a whale.
