论生态文明建设法律保障体系的构建

生态文明既可以是人类在处理人与自然关系中所取得的积极成果的总和,也可以是一种更高级的社会形态。生态文明建设的实现不仅需要相应的理念和价值追求的更新,也需要完善的法律保障。经过30多年的改革开放,我国已经基本建立了生态文明建设的法律保障体系,但其体系的构成、原则的组成、制度的建设尚存在不系统、不完整、不适应、不科学的问题和缺陷。构建生态文明建设法律保障体系,从法律框架体系上,应当制定以《生态文明建设基本法》或《环境保护基本法》为龙头,以污染防治、资源保护、生态保护、资源和能源节约法为分支的完整体系,在所有立法中贯彻生态优先、不得恶化、生态民主、共同责任的基本原则,并分别从预防、管控、救济三个维度建立起完善的生态文明建设法律保障制度。

On Establishment for Legal Guarantee System of Ecological Civilization Construction

Ecological civilization is either the positive result of how human beings deal with the nature or a kind of more advanced social formation. The realization of ecological civilization construction depends on not only renewal of the corresponding philosophy and value pursuit,but also the sophisticated legal guarantee. After thirty years reform and opening,we have basically established the legal guarantee system of ecological civilization construction. However,the system structure,the principle composition and the institutional improvement still have the problems and deficiencies of being not systematic,not integrated, not accommodative and not scientific. Establishment for legal guarantee system of ecological civilization construction,in the respect of law framework,should establish an integrated system,in which Ecological Civilization Construction Basic Law or Environmental Protection Basic Law is a leading element,and pollution prevention,resources protection,ecological protection,and resources and energy conservation are branch elements. We should stick to the basic principles of ecology first,no more deterioration,ecological democracy,and common responsibility in all legislation. We should establish the sophisticated legal guarantee system of ecological civilization construction from three aspects,prevention,regulation,and relief.
