| 摘 要： | 1978年宪法基本上保持了1975年宪法关于宪法权利和公民的基本权利规定的精神,恢复了一部分被1975年宪法所取消的195 4年宪法所规定的宪法权利和公民的基本权利,同时还规定了一些新的宪法权利,为1982年宪法关于宪法权利和公民的基本权利的规定奠定了法律基础。1978年宪法,在我国的人权保障事业的发展进程中,起到了承上启下的作用,其历史性地位不容忽视,其制度意义不容否定。

| Abstract: | The Constitution of 1978 basically kept the spirit of the Constitution of 1975 in the aspect of constitutional rights and the basic rights of citizens, and recovered some of constitutional rights and the basic rights of citizens stipulated in the Constitution of 1954 but repealed in the Constitution of 1975 and added some new constitutional rights and the basic rights of citizens which rendered the foundation for the Constitution of 1982 in analysis of the characteristic of the Constitution of 1978. Therefore, the Constitution of 1978 played an important role in connecting the history and the presence in the developing process of protection of human rights. Its position in history can't be ignored and its significance in system can't be denied. |
