生产、销售伪劣商品罪与假冒注册商标罪的竞合问题探析

In the coincidence of crime of manufacturing or selling fake and inferior commodities and crime of counterfeiting registered trademarks, there are circumstances of “one behavior” and “two behaviors”, which can exert a direct influence on judging crime quantity forms. On the occasion of “ one behavior”, actors fake others; registered trademark in the process of manufacturing fake and inferior goods or fake registered trademark of others and then sell the goods in the process of manufacturing fake and inferior goods, imaginative joinder of offenses can be formed ; On the occasion of “two behaviors”, actors fake registered trademark whose goods are counterfeit and shoddy produced by others and then sell the goods, implicated offender can be formed. In accordance with crime quantity theory, imaginative joinder and implicated offender shall be sentenced to felony by one occasion.
