论我国监狱制度下囚犯的劳动权性质

囚犯劳动权作为囚犯人权体系中的一项基本权利，具有其自身的性质。在我国监狱制度下，罪犯的劳动权是不断提高的。但是，由于对劳动权性质的不合理的定位，在理论和实践上过分强调囚犯劳动的强制性与惩罚性，使得我们与联合国囚犯劳动制度存在一定的差距。为此，本文试图通过分析我国囚犯劳动权的性质，找出我们的不足之处，探索适合我国的囚犯劳动制度。
