The background for my discussion lies in administrative proceedings in China. According to Article 54 of the Administrative Procedure Law of China, if a specific administrative act is found to be in violation of a prescribed procedure, the court concerned can give a judgment to totally or partially abolish the administrative act. But what is a prescribed procedure？ Chinese legislation does not give a clear-cut answer.
