| 摘 要： | 平等是人类最重要的价值之一。平等理念发展的历史表明，平等的涵义既包含人与人之间的平等，也包含国家与个人之间的平等。平等的后一种涵义对刑事诉讼构造的合理性具有重要价值。刑事诉讼中的控辩平衡深刻反映了平等的价值和作用。控辩平衡的机制通过多种诉讼制度体现出来。
